Terms and Conditions

Welcome to Draft BI. These Terms and Conditions (“Terms”) govern your access to and use of the Draft BI website at draftbi.com and the Draft BI application (collectively, the “Service”), operated by Anders Forge LLC, doing business as Draft BI (“we”, “us”, or “our”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Account Terms
- You must be at least 16 years old to use the Service.
- You are responsible for maintaining the security of your account credentials. Draft BI is not liable for any loss resulting from unauthorized use of your account.
- You must provide accurate and complete information when creating your account and keep it up to date.
- One person or legal entity may maintain no more than one free account.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Use the Service to transmit any malware, viruses, or other harmful code.
- Reverse-engineer, decompile, or disassemble any part of the Service, except where permitted by applicable law.
- Resell, sublicense, or redistribute the Service or any output generated by the Service without our prior written consent.
3. Subscription Plans and Billing
3.1 Free Tier
The Service offers a free tier with limited features. Free-tier users may create unlimited projects and themes, with monthly limits on PBIR exports and AI Actions as described on our Pricing page. We reserve the right to modify free-tier limits at any time with reasonable notice.
3.2 Paid Subscriptions
Paid plans (Pro and Power) are billed on a monthly or annual basis. By subscribing to a paid plan, you authorize recurring charges at the applicable rate until you cancel.
3.3 Payment Processing by Polar
All payment processing for Draft BI is handled by polar.sh (“Polar”), which acts as our Merchant of Record. This means:
- Polar is the seller of record for all paid subscriptions. Your purchase is from Polar, not directly from Draft BI.
- Polar handles all payment processing, invoicing, sales tax/VAT collection, currency conversion, and compliance with local tax regulations.
- Your payment information is collected and stored by Polar. Draft BI does not store your credit card or payment details.
- Polar's Buyer Terms and Privacy Policy apply to your purchase in addition to these Terms.
3.4 EU and UK Consumer Withdrawal Rights
If you are a consumer located in the European Union or United Kingdom, you may have a statutory right to withdraw from a purchase within 14 days (the “cooling-off period”) under EU Directive 2011/83/EU and the UK Consumer Contracts Regulations 2013.
Because Draft BI is a digital service that begins immediately upon purchase, you expressly acknowledge and agree at the time of purchase that performance of the Service commences immediately and that you waive your right of withdrawal once access to the Service has begun. This acknowledgment is captured at the point of purchase through Polar's checkout flow.
This does not affect your rights under our 30-day refund policy in Section 4.2, or any mandatory rights you hold under applicable consumer law.
4. Cancellation and Refunds
4.1 Cancellation
You may cancel your paid subscription at any time through your account settings. Upon cancellation:
- Your subscription remains active until the end of the current billing period.
- You will not be charged for subsequent billing periods.
- Your account will revert to the free tier at the end of the paid period, and paid-tier features will no longer be accessible.
- Your data (projects, themes, saved measures) will be retained but subject to free-tier limits for new operations.
4.2 Refunds
We offer a 30-day refund window from the date of purchase or renewal. If you are unsatisfied with the Service, you may request a full refund within 30 days of being charged. Since Polar is the Merchant of Record, all refund requests are processed by Polar. You may request a refund by contacting Polar directly through your purchase receipt or by reaching out to our support team at support@draftbi.com, and we will facilitate the request with Polar on your behalf.
5. Intellectual Property
5.1 Our Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by Draft BI and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described herein.
5.2 Your Content
You retain ownership of all content you create using the Service, including but not limited to Power BI theme files, canvas layouts, DAX measures, and project data. By using the Service, you grant us a limited license to store, process, and display your content solely to operate and improve the Service.
5.3 AI-Generated Content
Content generated by AI features (such as AI Wireframing and Model Studio) is provided as-is. You are responsible for reviewing and validating any AI-generated content before using it in production. We make no warranty regarding the accuracy, completeness, or fitness of AI-generated outputs.
6. Service Availability and Modifications
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make commercially reasonable efforts to notify users of material changes.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We collect and process personal data as necessary to provide the Service, including account information, usage analytics, and project data. We do not sell your personal data to third parties.
PBIR exports are generated entirely in your browser. No project data is sent to our servers during the export process.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Draft BI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us (via Polar) in the twelve (12) months preceding the claim.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. For users who are consumers under applicable EU, UK, or other national consumer protection law, the limitations above apply only to the maximum extent permitted by mandatory applicable law. Your statutory rights as a consumer are not affected.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Draft BI does not warrant that the Service will meet your specific requirements, that exported files will be compatible with all versions of Power BI Desktop, or that AI-generated content will be accurate or error-free.
10. Indemnification
You agree to indemnify, defend, and hold harmless Draft BI from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, with or without notice depending on the severity of the violation. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, and indemnification) shall survive.
12. Governing Law and Dispute Resolution
12.1 Business Users
For users accessing the Service for commercial or business purposes, these Terms are governed by the laws of the State of Michigan and the United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in Michigan.
12.2 Consumer Users — General
We aim to resolve disputes informally. Please contact us at support@draftbi.com first. We will make reasonable efforts to resolve your concern within 30 days.
12.3 Consumer Users — EU and EEA
If you are a consumer in the European Union or European Economic Area, these Terms are governed by Michigan law to the extent permitted by mandatory EU consumer protection laws. However, you retain the benefit of any mandatory protective provisions of the law of your country of residence that cannot be derogated from by contract. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12.4 Consumer Users — United Kingdom
UK consumers retain the benefit of mandatory protective provisions under UK law, including the Consumer Rights Act 2015. The choice of Michigan law does not deprive you of protection afforded by such mandatory provisions.
12.5 Consumer Users — Australia
Australian consumers retain rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), which cannot be excluded by contract.
12.6 Consumer Users — Canada
Canadian consumers retain rights under applicable provincial consumer protection legislation, which cannot be excluded by contract.
13. Export Controls and Sanctions Compliance
Draft BI is subject to United States export control laws and regulations, including the Export Administration Regulations (EAR) and sanctions programs administered by the U.S. Office of Foreign Assets Control (OFAC).
You may not use Draft BI if you are:
- Located in, or a national of, a country subject to comprehensive US sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine);
- Listed on any US government restricted party list, including the OFAC Specially Designated Nationals list; or
- Otherwise prohibited from using US-origin software or services under applicable law.
By using Draft BI, you represent and warrant that none of the above apply to you.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
